GAZEBO REGULATIONS
I.The Gazebo
may be reserved and used by Windgate II or Windgate III unit owners or residents for private social functions only by prior reservation and with authorization by the Windgate II or Windgate III Unit Owners Association. Application for the use of the Gazebo should be made two weeks prior to the function, on a form provided by the Association Office (see below). The Windgate II or Windgate III Unit Owners Association, acting through the Board of Directors (or when delegated, its officers), will grant permission to use the Gazebo area at its sole discretion.
II. The privacy and quiet
of Windgate II and Windgate III should be preserved. Accordingly, the Gazebo area may be reserved for such private functions only between the hours of 10:00 a.m. and 12:00 a.m. (midnight). Any music that draws complaints from residents after 10:00 p.m. will be viewed as excessively loud and must be reduced to a level acceptable by residents. All functions must terminate by midnight, and guests must disperse promptly and quietly.
III. The resident who has reserved the Gazebo
(the "host") must maintain the orderly conduct and control of guests. The use of alcohol by the host and his/her guests is not permitted in the gazebo area.
IV. When extending invitations
to the social functions to non-residents, the host must inform guests that parking is not permitted in the parking lots and that guests must park on South Arlington Mill Drive. The host is responsible for ensuring that guests do not park in the condominium parking lot. Guests who park in the condominium lot do so at the risk of being towed.
V. At least four (4) days prior
to the social function, the Association Office will advise the residents of units 2508-A through 2508-E and buildings 2600 and 2602 and the Board of Directors of the social function.
VI. The host must submit a security deposit
of $100 if the social function has either of the following characteristics:
- More than 50 guests are expected or invited;
- Music is to be played after 10:00 p.m.;
If the social function has neither of the preceding characteristics, the security deposit will be $25.
VII. The host must clean up
the Gazebo after the social function and restore it to its original condition.
VIII. In case of violation
of any of the foregoing rules, or any of the rules, regulations, and Bylaws pertaining to the use of the Windgate II or Windgate III common elements:
- The security deposit is subject to forfeiture;
- Any officer of Windgate II or Windgate III, a police officer, or Association employee or agent may terminate the party and require that guests disperse;
- The host will be liable to the Windgate II and Windgate III Unit Owners Associations to the extent that the damages and costs (including the cost of clean-up work performed by Windgate II or Windgate III employees) exceed the security deposit.
