Windgate II - SWIMMING POOL REGULATIONS

The following rules and regulations are for the protection and benefit of all residents and guests at Windgate II and Windgate III to assure safe and sanitary operation of the pool facilities. Your cooperation in abiding by these conditions will afford pleasant relaxation and recreation for all. Residents will be expected to observe all rules and regulations and to obey all instructions from the lifeguard. Any failure to comply with these rules shall be considered sufficient cause for barring of violators from the use of the pool area.

PERSONS USING THE POOL AREA DO SO AT THEIR OWN RISK AND RESPONSIBILITY.

I. Hours of Operation

The pool will open on Saturday, May 27, 2006 and will remain open through Monday, September 4, 2006. The pool weekend hours will be extended two additional weekends of September 9 & 10, and September 16 & 17, 2006.

The pool may be closed at any time due to inclement weather, mechanical failure, or other operational difficulties at the discretion of the lifeguard or the managing agent.

II. Safety Rules

  1. Running, pushing, wrestling, or causing undue disturbances in or about the pool area will not be tolerated.
  2. Ball playing is only allowed in the water and when everyone in the pool is involved in ball playing. Individuals may not throw balls to persons standing on the deck. Only beach balls or soft foam balls may be used. Tennis balls are prohibited.
  3. Rafts, etc. The lifeguard may allow pool users to use rafts, water wings, life preservers, or other play equipment when pool occupancy permits. Instructional devices may be used in conjunction with training under the direction of the lifeguard.
  4. Wheeled vehicles, other than wheelchairs or strollers, are prohibited in the pool area.
  5. Admission will be refused to all persons having infectious diseases, sore or inflamed eyes, colds, nasal or ear discharges, or any communicable disease of any kind. Persons with excessive sunburn, open sores, or bandages of any kind will not be admitted.
  6. Spouting of water and other similar unhygienic actions will not be permitted in the pool.
  7. Babies must wear diapers and plastic pants when in the pool.
  8. Glass containers will not be allowed in the pool area. No food may be consumed in the immediate vicinity of the pool area. All trash and refuse must be placed in the receptacles provided. Smoking materials are to be extinguished only in the receptacles provided.
  9. Possession and consumption of alcoholic beverages within the fenced-in pool area is strictly prohibited.
  10. All emergencies are to be reported immediately to the lifeguard who will then take charge of the situation. A written statement is to be filed with the pool Management Company and the Association Office the following business day, if such action is taken.
  11. Lifeguard is required. Use of the pool facilities without a lifeguard in attendance is strictly prohibited. The pool may not be used (1) after it closes each evening and before it opens each morning or (2) after it closes at the end of the summer and before it opens the following spring. Anyone who enters the pool area when the pool is closed will be considered trespassing.

III. General Regulations

  1. Pool passes will be issued only to those residents whose unit's account is current in condominium payments and not in violation of any architectural standards. Pool passes must be revalidated each year prior to the beginning of the pool season.
  2. Show pool passes. The pool is for the use of Windgate II and Windgate III residents and their guests. All residents must present a valid Windgate II or Windgate III Recreation Card to the lifeguard upon entering the pool area. Guests must sign the guest book maintained by the lifeguard.
  3. Children under 12 years of age must be accompanied by an adult 18 years of age or older for admission to the pool area.
  4. Guests. Because of the size of the pool and deck area, each condominium unit will be permitted no more that four guests on weekdays and no more than two guests on weekends and holidays. Guests must be accompanied by a resident (12 years of age or older) having a Windgate II or Windgate III Recreation Card. Any resident under the age of 12 must have a parent/guardian accompany his/her guests. Residents who desire guests to have access to the pool unaccompanied may do so by notifying the lifeguard ahead of time for the days the guest will use the pool. No one under 18 may pre-authorize a guest. A pre-authorized guest may then show any means of identification (or if a child, merely state his/her name) to gain access. Any exception to these admittance procedures must be approved in writing and in advance by the Board of Directors of Windgate III.
  5. The costs of any property damage will be charged to the responsible party. Residents will be held responsible for all actions of their guests. Parents will be held responsible for all actions of their children and their children's guests. The Unit Owners' Associations of Windgate II and Windgate III will not be responsible for loss or damage to any personal property of any kind.
  6. With the exception of Seeing-Eye dogs, pets are not allowed in the pool area.
  7. Playing of radios, cassette players, or other electronic devices is prohibited unless earphones are used.
  8. Lap swimming. During the following times, priority will be given to lap swimmers.
    1. The last 15 minutes of each hour (except the last hour of the day) that the pool is open.
    2. From 7:00 p.m. to 8:00 p.m. on Weekdays (except holidays).
    3. From 10:00 a.m. to 11:00 a.m. on Saturdays, Sundays, and holidays. During these hours, bathers will be required to stay outside the paths of lap swimmers.
  9. Adult swim. The last 15 minutes of each hour will be reserved for adult use of the pool; children under the age of 12 will not be allowed in the pool during the last 15 minutes of each hour. This will be strictly enforced.
  10. Lifeguard. The lifeguard is responsible for the enforcement of the pool rules and regulations. He/She has authorization to temporarily deprive any resident or guest of the use of the pool facility. A written statement is to be filed with the Management Company by the following business day, if such action is taken.
  11. All persons using the pool furniture must place a towel over the lounge or chair before sitting/laying down to limit oils (body and suntan lotions) from deteriorating and staining the vinyl straps of the furniture.

NO TRESPASSING, VIOLATORS WILL BE PROSECUTED
